fa المعاییر الدولیه للحق فی اللغه الرسمیه للأقلیات وانعکاساتها علی السیاسات اللغویه تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="AR-SA" style="font-size:14.0pt"><span style="line-height:115%"><span style="font-family:&quot;Traditional Arabic&quot;,serif">نتطرق فی هذه الدراسه التأصیل القانونی والفلسفی للحقوق اللغویه بوصفها فرعاً حیویاً من فروع القانون الدولی لحقوق الإنسان، وتحدیداً حقوق الأقلیات القومیه والإثنیه، إذ تتبلور إشکالیه البحث فی رصد مدی إلزامیه المعاییر الدولیه الصادره عن منظمه الأمم المتحده والمواثیق الإقلیمیه (کالاتفاقیه الأوروبیه للغات الإقلیمیه أو لغات الأقلیات) فی کفاله الحق فی اللغه الرسمیه والاستخدام الإداری للأقلیات، ومدی انعکاس هذه القواعد الدولیه علی صیاغه السیاسات اللغویه الوطنیه والتشریعات الدستوریه الداخلیه، وتتبع الدراسه المنهج التحلیلی المقارن لحل التنازع القائم بین رغبه الدوله فی فرض سیادتها اللغویه کأداه للاندماج الوطنی والسیاسی، وبین التزاماتها الاتفاقیه بحمایه التعددیه الثقافیه والهویه الإدراکیه للأقلیات، وتخلص الدراسه إلی وجوب انتقال المشرع الوطنی من المقاربه الاستیعابیه القائمه علی أسلوب الحمایه إلی المقاربه التمکینیه التشارکیه عبر مأسسه الحوکمه اللغویه وتفعیل الأثر الإجرائی للألسن الفرعیه فی المرافق العامه والمرفق القضائی</span></span></span><span dir="LTR" style="font-size:14.0pt"><span style="line-height:115%"><span style="font-family:&quot;Traditional Arabic&quot;,serif">.</span></span></span></span></span></span></span></span><br> &nbsp; <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:501px; padding:0cm 7px 0cm 7px; height:124px"><span style="font-size:11pt"><span style="line-height:normal"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;Times New Roman&quot;,serif">This study examines the legal and philosophical foundations of linguistic rights as a vital branch of international human rights law, specifically concerning the rights of national and ethnic minorities. The central research problem lies in monitoring the extent to which international standards issued by the United Nations and regional conventions&mdash;such as the European Charter for Regional or Minority Languages&mdash;are binding in guaranteeing minorities the right to an official language and administrative use. Furthermore, it assesses how these international rules reflect upon the formulation of national linguistic policies and domestic constitutional legislation. Adopting a comparative analytical method, the study addresses the ongoing conflict between the state&rsquo;s desire to assert its linguistic sovereignty as a tool for national and political integration, and its treaty obligations to protect cultural diversity and the cognitive identity of minorities. The study concludes that national legislatures must shift from an assimilimonious, protection-oriented approach to an empowering, participatory one.
